Procedural History
• Respondent, Rodney Gant, was arrested concerning driving with a suspended license. Subsequent to the try of the Gant’s vehicle officers construct cocaine in the back seat. At burden Gant moved to have the evince suppressed denied that there was to be expected cause to search the vehicle, but that did not decide to suppress the proof. The court ruled the search to subsist that incident to an arrest. Respondent was mould guilty and sentenced to three-year prison term.
The Facts
• Officers were called to a legal settlement on an anonymous tip that it was essence used to sell drugs out of. When officers arrived at the sojourn, Rodney Gant answered the door.
• After claiming that the proprietor of the residence was not home police left the place of abode but stayed in the area tarrying for the owner to arrive. They had effected a check on Mr. Gant and discovered that he had a pendulous license.
• While waiting police arrested sum of ~ units others for giving false identification and notwithstanding possession of drug paraphernalia. Mr. Gant had obviously left the residence and was pulling up to the place of ~ while the officers were arresting the other sum of ~ units individuals. Officers confirmed that he was in thing done the driver of a vehicle workmanship its way into the driveway. After exiting the medium, officers called to Gant and he was arrested concerning driving on a suspended license.
• As officers even now had the other two individuals in sum of ~ units separate cars and using both sets of restraints, they called for back up. When back up arrived, Gant was handcuffed and placed inside the back of one of the arriving police vehicles. Once Gant was secured the officers afterward did a search of his medium where they discovered a gun and a jerkin in the back seat that had a reticule of cocaine in one of the pockets.
